What you buy

A personalised decorative figurine, 3D printed in PLA from your photo and confirmed choices: subjects, pose, height, finish and quantity. The filament has one colour; a marble, wood or metallic effect does not mean stone, solid wood or metal. Unless expressly agreed, the purchase does not include 3D files or commercial reproduction rights.

Photo, preview and approval

The preview is an AI-generated simulation, not a photograph of the finished print. Reconstruction of hidden areas, likeness, fine details and on-screen colour have limits. Layers and support marks may be visible. These characteristics do not excuse a faulty product or one that differs from what was agreed.

The production model is checked before printing. Material changes to the pose, number of subjects, base, dimensions or appearance require your approval; silence is not approval. We do not impose price increases after ordering: requested changes are agreed separately. If we cannot make the agreed product, we offer a solution you may reject and refund the amounts due for an order we cannot fulfil.

Placing an order

Check the photo, options, address, destination, price and times, and correct errors before confirming. Uploading a photo or creating a preview is not a purchase. A real order creates a payment obligation only through a button that clearly states this; the seller’s acceptance and confirmed price appear in the order confirmation. Keep the confirmation and this version of the terms.

During testing, Stripe simulates payment: an order is not a real sale, creates no real charge and does not start production.

Price and payment

The summary separates the figurine price, shipping and any taxes collected by the seller. The confirmed figurine price includes materials, work and packaging; internal production costs are not later surcharges. The amount payable is shown in CHF before confirmation. If your card uses another currency, exchange rates and bank charges depend on your card agreement.

Where import charges are payable by the recipient, the amount paid to Formacara excludes import VAT, customs duty and local clearance fees, disclosed separately before ordering. Estimates are not a customs assessment. No optional extras are added without agreement.

Production and delivery

10–15 working days from approval of the production model.

Transit time is additional to production and is shown for the available service, separately from possible customs checks. We communicate delays and a revised estimate. Your legal remedies for late or failed delivery, including termination and refund where applicable, remain intact. Only destinations enabled for your address can be ordered, not automatically every European territory.

Personalised orders and changing your mind

Your figurine is made from your photo and individual specifications. For EU consumers, the ordinary 14-day withdrawal right does not apply to clearly personalised goods or goods made to consumer specifications in the cases covered by Article 16(c) of Directive 2011/83/EU. The UK also has an exception for these goods. Switzerland has no general statutory change-of-mind right for online purchases.

To request a change or cancellation, contact info@formacara.com promptly: we check the stage reached and respond before any agreed charges. The absence of a change-of-mind right does NOT remove rights concerning defects, non-conformity, non-delivery or other statutory remedies. If a future offer is not personalised, the applicable cancellation right and procedure must be provided separately.

Defects, damage and legal guarantee

If the figurine is damaged, does not conform or fails to arrive, contact info@formacara.com with the order reference. Photos of the item and packaging help investigation; we do not impose a 24- or 48-hour deadline that removes statutory rights. We remain your point of contact even for transit damage.

EU consumers benefit from at least a two-year legal guarantee of conformity, or the longer period required by the applicable country. Remedies include repair or replacement free of charge and, where the legal conditions are met, a price reduction or termination with refund. Swiss Code of Obligations rights and their applicable periods remain available and are not excluded by these terms. In the UK, mandatory remedies for faulty or misdescribed goods remain available, including the statutory short-term right to reject where applicable. Necessary return costs for an established defect are borne by the seller.

Delivery risk, uncollected parcels and returns

The seller bears the risk of loss or damage until physical delivery to you or a person you designate, except for specific statutory exceptions involving a carrier independently arranged by the consumer. Please provide a correct address and cooperate with legitimate customs requests. Failing to collect a parcel does not automatically forfeit everything paid: we assess the circumstances and any actual, proportionate, disclosed costs without limiting mandatory rights.

Contact us for return instructions; not obtaining an authorisation code does not extinguish a legal right. Refunds use the same payment method unless another method is agreed at no cost. Taxes collected directly by customs may require a separate refund procedure with the relevant authority.

Photo rights

Upload only photos you can lawfully use, with the necessary permissions from people pictured and other right holders. Photos of minors require authorisation from the person responsible for them. You authorise use of the photo and transformations only for your request, production, support and related obligations. We do not acquire ownership of your photographs. Gallery publication, advertising and marketing require separate, optional permission.

Safe use

The figurine is a decorative object, not a toy or an item intended for food contact. Thin parts and fragments may break: keep it away from small children and hold it by the base. Avoid flames, heat sources, hot cars and dishwashers. Model-specific warnings and product identification accompany delivery; a label alone does not replace required safety checks.

Complaints and applicable law

For help or complaints, contact info@formacara.com. We first seek a practical solution and retain order records. No term excludes mandatory liability or remedies or imposes exclusive jurisdiction contrary to consumer rights.

Swiss law applies without depriving consumers of mandatory protections under the law of their habitual residence where applicable. Competent courts and legal redress remain available. Later changes to the terms do not change the version accepted for an existing contract.
